1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Boats Baja website (boatsbaja.com) and your booking of fishing charters, shared tours, yacht trips, and related services ("Services") offered by Boats Baja Sport Fishing Charters ("Boats Baja," "we," "us," or "our"), located at Marina A Dock, Cabo San Lucas, Baja California Sur, Mexico.
By requesting a quote, submitting a booking form, making a payment, or boarding a charter, you agree to these Terms. If you do not agree, do not use our Services.
2. Services and Bookings
Boats Baja arranges private and shared sportfishing charters, yacht excursions, and related tours departing from Marina Cabo San Lucas. Charter descriptions, pricing, inclusions, and vessel specifications on our website are subject to availability and may be updated without notice.
A reservation is confirmed only after you receive written confirmation from Boats Baja and, where applicable, payment is received according to the agreed deposit or full-payment terms. Quotes submitted through our website are estimates and not binding until confirmed.
3. Pricing and Payments
All prices are quoted in United States Dollars (USD) unless otherwise stated. Charter rates typically include captain, crew, fishing gear, bait, licenses (where stated), drinks, and fuel as described on the specific charter page or confirmation email.
Online payments are processed securely through Stripe. By providing payment information, you authorize us and Stripe to charge the agreed amount. You are responsible for any foreign transaction fees charged by your bank or card issuer. Mexican sportfishing licenses, dockside gratuities, and optional add-ons not included in your quoted rate may be collected separately as disclosed at booking.
4. Cancellation and Refund Policy
We understand plans change. Our standard cancellation policy is as follows:
- 14+ days before your scheduled charter: You may cancel for a full refund of amounts paid to Boats Baja, minus any non-refundable third-party fees if disclosed at booking.
- Less than 14 days before departure: Cancellations may be subject to partial or no refund depending on boat availability, rebooking efforts, and costs already incurred. Contact us as soon as possible to discuss options.
- Weather and safety: If the captain determines conditions are unsafe, we will offer to reschedule your trip or provide a refund or credit according to the circumstances. Final safety decisions rest with the licensed captain.
- No-shows: Failure to arrive at the marina at the agreed time without prior notice may result in forfeiture of payment.

5. Fishing Licenses and Regulations
Mexican law requires a valid sportfishing license for each angler over 11 years of age. Boats Baja can assist with license arrangements. All guests must comply with CONAPESCA regulations, including daily catch limits and species restrictions. Our crew will advise on applicable rules; violations may result in fines imposed by authorities and are the guest's responsibility.
6. Assumption of Risk and Liability
Fishing, boating, and marine activities involve inherent risks including, but not limited to, seasickness, sun exposure, slippery surfaces, hooks, lines, wildlife, and changing weather. By participating, you voluntarily assume these risks.
To the fullest extent permitted by applicable law, Boats Baja, its owners, employees, captains, crew, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability for any claim related to a charter shall not exceed the amount you paid for that specific booking.
Boats Baja is not responsible for personal property lost or damaged aboard the vessel, travel delays, missed flights, or expenses arising from factors outside our reasonable control.
7. Guest Conduct
Guests must follow captain and crew instructions at all times. Intoxication, unsafe behavior, harassment, or damage to the vessel or equipment may result in termination of the trip without refund. Boats Baja reserves the right to refuse service to any person who poses a safety risk or violates these Terms.
8. Gratuities
Crew gratuities are not included in charter pricing unless explicitly stated. A customary tip of 15–20% of the charter rate is appreciated for excellent service and is paid directly to the crew at your discretion.
9. Intellectual Property
All content on boatsbaja.com — including text, photos, logos, and design — is owned by Boats Baja or used under license. You may not reproduce, distribute, or exploit our content without prior written permission.
10. Privacy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect and use personal information submitted through quote forms, booking flows, and Stripe payments.
11. Governing Law
These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Any dispute arising from these Terms or your charter shall be subject to the exclusive jurisdiction of the competent courts in Baja California Sur, Mexico, unless otherwise required by mandatory consumer protection laws in your home country.
12. Changes to Terms
We may revise these Terms at any time. The "Last updated" date reflects the latest version. Material changes will be posted on this page. Continued use of our website or Services after changes constitutes acceptance of the revised Terms.
